The same U.S. federal district judge that declared the Affordable Care Act (ACA) unconstitutional in\u00a0Texas v. California<\/em><\/a><\/strong>\u00a0has issued a\u00a0ruling<\/a><\/strong>\u00a0in a lawsuit,\u00a0Braidwood Management Inc. v. Becerra\u00a0<\/em>(formerly known as\u00a0Kelley v. Becerra<\/em><\/a><\/strong>), that strikes down a requirement that health plans cover and waive cost-sharing for many critical preventive services. Although the U.S. Department of Justice is likely to appeal the ruling, some legal experts believe the\u00a0Braidwood Management<\/em>\u00a0plaintiffs may prevail in the higher courts, too.<\/p>\n

The preventive services benefit is one of the\u00a0more popular<\/a><\/strong>\u00a0provisions of the ACA. The loss of this protection means that over\u00a0167 million<\/a><\/strong>\u00a0people will need to pay out-of-pocket for dozens of\u00a0critical<\/strong>\u00a0preventive services<\/strong><\/a>. When confronted with hefty deductibles or coinsurance, people tend to delay or forego even essential preventive services, making them more susceptible to costly and serious illness.<\/p>\n

If the ACA\u2019s preventive services provision is gutted, only Congress can fully restore it. Still, there are steps that state policymakers can take to help many of their residents maintain this coverage.
